Vitality Fitness Tavistock - Terms and Conditions

Welcome to Vitality Fitness Tavistock! By signing up for a membership or pass plan, you agree to abide by the following terms and conditions. Please read them carefully.
1. Membership Eligibility
1.1 Membership is open to individuals aged 16 years and older who wish to use the gym independently.
1.2 Individuals aged 15 'may' use the gym with a parental guardian and under the 'minor membership plan' of gym usage from Monday to Friday: 15:30 - 19:30 (last entry at 19:00; gym must be vacated by 19:45) / Saturday & Sunday: 10:00 - 18:30 (last entry at 18:00; gym must be vacated by 18:45). Once the user turns 16, they will automatically transfer to a student rolling direct debit membership. We do not permit access for 15-year-olds under parental supervision, out of these hours. Our insurance coverage only applies during staffed hours.
1.3 All members must provide valid identification at the time of sign-up if for a student or senior plan. A valid student ID is required for student discounts and an identification card is required for a senior plan, and VFT reserves the right to request ID verification for anyone who appears to be under the age of 16.
2. Personal Health and Medical Conditions
2.1 Members are required to ensure they are in a fit and healthy condition to join a gym. This includes disclosing any existing health conditions, injuries, or concerns, including pregnancy, that may affect their ability to participate in physical activities.
2.2 By signing the Physical Activity Readiness Questionnaire (ParQ), members acknowledge their responsibility to assess their health and fitness levels.
2.3 The club reserves the right to request a doctor’s note if any concerns arise regarding a member’s health as noted in their ParQ.
3. Membership Plans and Fees
3.1 Flexible Membership Options
At Vitality Fitness Tavistock, we offer a range of flexible membership plans to fit your lifestyle. Choose from pay-as-you-go options, rolling direct debits, or fixed-term contracted plans.
3.2 Pay-As-You-Go Plans
Pay-as-you-go memberships are non-refundable and cannot be frozen once purchased.
3.3 Rolling Direct Debit Plans
Rolling direct debit memberships require one month’s notice for cancellation. Depending on your notice date, a final payment may still be collected if it aligns with the next collection cycle. This final payment is non-refundable. To avoid additional charges, we recommend notifying us at least six days before your collection date to ensure only one final payment is processed for the following month.
3.4 Fixed 3-Month Commitment Plans
With our 3-month fixed plans, you can choose to switch or cancel your membership after the third payment. You’ll have a 25-day window following your third payment to contact us via email with your decision. If we do not hear from you within this period, your plan will automatically renew for another 3 months.
3.5 Membership Discounts
We’re pleased to offer discounted memberships for students, minors, and seniors.
Please note that all membership fees are non-refundable and subject to change with prior notice.
3.6 Pre-Sale and Black Friday Memberships
Our Pre-Sale and Black Friday discounts! These no-contract memberships require a non-refundable £15 sign-up fee to secure your discounted plan, which will be activated when we open on December 14th, 2024.
4. Access and Usage
4.1 Members have 24/7 access to the gym facilities. Minors do not have 24/7 access.
4.2 Members must use their unique membership number to gain access to the gym and sign in/out upon entering and leaving.
4.3 Members are responsible for the security of their membership number and must not share it with others.
4.4 Any unauthorised use of a member's account may result in immediate cancellation of membership.
5. Induction Training
5.1 While health and safety regulations do not require users to undertake induction training on gym equipment, members who choose not to participate in an induction do so at their own discretion and will acknowledge this decision during the ParQ section of their sign-up agreement.
5.2 Members aged 16 and under are required to complete an induction before training.
5.3 Inductions can be booked via phone or email, and the club also offers detailed training induction plans available on our app and in hard copy within the gym to support users in understanding our equipment.
6. Safety and Familiarity
6.1 All members must familiarise themselves with the gym’s safety pack, which outlines important safety procedures and guidelines for emergency help.
6.2 It is the responsibility of each member to understand and adhere to all safety protocols as outlined in the safety pack.
7. Gym Etiquette
7.1 Members must follow proper gym etiquette at all times, including respecting equipment, other members, and staff.
7.2 Failure to adhere to gym etiquette may result in a ban from the facility. Gym Etiquette is displayed in the gym and on our app.
8. Guest Policy
8.1 Members may bring guests to the gym, but guests must sign up for a day pass or pass plan online before entering the facility.
8.2 Guests must also sign in and out, following the same procedures as members.
8.3 Failure to comply with this policy may result in the member’s account being suspended or canceled.
Unauthorised Access
Members must not bring non-members into the gym without the guest purchasing a valid day pass or relevant membership plan for that individual online before entering the building. Please refer to our Guest Pass Policy to learn the correct process for bringing a friend into the gym.
Violation of this policy will result in the following actions:
First Offence: Your account will be frozen while we contact you to identify the individual involved. A £25 fine per unauthorised person will be applied to your account.
Second Offence: Your account will again be frozen and investigated. A £35 fine per unauthorised person will be applied.
Third Offence: A £50 fine per unauthorised person will be issued. You will receive an immediate ban from The Zone Callington.
9. Conduct and Safety
9.1 All members are expected to conduct themselves in a respectful and courteous manner towards staff and fellow members.
9.2 Aggressive behaviour, harassment, or any form of discrimination will not be tolerated and may result in immediate termination of membership.
9.3 Members must adhere to all gym policies, including safety guidelines and equipment usage instructions.
10. Cancellation and Notice
10.1 Pay-as-you-go Plans: As pay-as-you-go memberships are non-refundable, no cancellation is required as it ends automatically.
10.2 Rolling Direct Debit Plans: To cancel a rolling direct debit membership, members must give one month's notice by submitting a written request via email. It’s recommended to notify us at least 6 days before your payment collection date to avoid any additional payments beyond the final month.
10.3 Fixed 3-Month Commitment Plans: After the third monthly payment, you will have a 25-day window to notify us via email if you wish to switch plans or cancel. Failure to do so will result in automatic renewal for another 3 months.
10.4 Memberships will automatically renew unless a cancellation request is received prior to the renewal date - this does not include PAYG plans.
11. Classes
11.1 All classes are included as part of our membership plans. If you need to cancel a class, you must email hello@vitalityfitnesstavistock.com and inform the admin team—please do not message trainers directly. If you cancel within 24 hours of the scheduled class time or fail to attend without prior notice (no-show), a fee of £5 will be charged per missed class.
12. Liability
12.1 Vitality Fitness Tavistock is not responsible for any personal injury, loss, or damage to personal belongings that occur on the premises.
12.2 Members should consult with a physician before beginning any exercise program, especially if they have pre-existing health conditions, including pregnancy.
13. Amendments
13.1 Vitality Fitness Tavistock reserves the right to amend these terms and conditions at any time. Members will be notified of any significant changes via email or through posted notices in the gym.
14. Governing Law
14.1 These terms and conditions shall be governed by and construed in accordance with the laws.
By signing up for a membership at Vitality Fitness Tavistock, you acknowledge that you have read, understood, and agreed to these terms and conditions.
Liability Waiver and Release Agreement
Acknowledgment of Risk
I, the undersigned, acknowledge that I am voluntarily participating in the above-mentioned activity. I understand that this activity may involve inherent risks, including but not limited to physical injury, illness, property damage, or even death. I fully accept and assume all risks associated with my participation.
Release of Liability
In consideration for being permitted to participate in this activity, I hereby release, waive, and discharge Vitality Fitness Tavistock, its officers, employees, agents, and volunteers from any and all liability for any injury, loss, or damage to my person or property arising out of or in connection with my participation in this activity, whether caused by negligence or otherwise.
Indemnification
I agree to indemnify and hold harmless Vitality Fitness Tavistock from any claims, demands, actions, or causes of action that may arise out of my participation in this activity.
Medical Treatment
In the event of an emergency, I consent to receive medical treatment deemed necessary. I understand that I am responsible for any medical expenses incurred as a result of such treatment.
Governing Law
This waiver shall be governed by and construed in accordance with the laws.
Severability
If any provision of this waiver is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Acknowledgment of Understanding
I have read this Liability Waiver and Release Agreement carefully, fully understand its terms, and sign it freely and voluntarily. I acknowledge that by signing up to this gym I am giving up legal rights that I may have.
